The Bundestag Tackles a Renewed Effort on Assisted Suicide Law

Law implementing workplace provisions for assisted death

In the wake of the Federal Constitutional Court's landmark ruling on self-determined dying, Bundesligt MP Lars Castellucci is spearheading a fresh legislative push. After two failed attempts in 2023, a new draft is in the works. Castellucci confidently shares, "I'm certain we'll swiftly forge a sensible legislative reform in this term." He insists that the legislator must establish a "clear and balanced regulation" on assisted suicide following the court's ruling.

This new initiative has sparked enthusiasm among supporters, with a working group already mobilized and the first meeting held. Castellucci also stresses the importance of respecting those who choose self-determined death, while avoiding normalizing or pressuring vulnerable individuals.

Ethics Council Plays Supporting Role

Chairman of the German Ethics Council, Helmut Frister, endorses the lawmakers' initiative. "I find the Bundestag's efforts to regulate assisted suicide commendable and logical," he shares. Frister anticipates no successor provision for the overturned paragraph this time, describing this as a positive step both in terms of content and increasing the initiative's likelihood of success.

A Long and Twisting Road

Since 2015, the Bundestag has battled with legislation on assisted suicide, culminating in a law prohibiting commercial and repeated assisted suicide. In February 2020, the Federal Constitutional Court overturned this law, acknowledging a fundamental right to self-determined dying. However, the legal details have yet to be established since.
