New Smoking Law in Spain to Take Effect by 2026

Spain is set to implement a new balance in its smoking regulations by 2026, which will bring significant changes to the country's tobacco and e-cigarette regulations. The news will affect both residents and tourists alike.

One of the key aspects of the breaking news is the treatment of electronic products, such as e-cigarettes and vapes, as tobacco products for the first time. This means that the use of these products will be subject to the same restrictions as traditional tobacco products.

Rental car providers often prohibit smoking contractually, and violators may face significant cleaning fees or contractual penalties. However, the new balance will extend this ban to vehicles parked on public land, with violations near designated smoke-free zones (e.g., bus stops, hospitals) being penalized.

In private cars, smoking is allowed if no minors under 18 are present. Otherwise, fines of up to 1,500 euros may apply. The sale of disposable vapes will be phased out, and advertising for tobacco and e-cigarettes will be heavily penalized, with violations punishable by fines of up to 600,000 euros.

The new balance will also introduce a general smoking ban in taxis, ride-hailing vehicles, and buses. Tourists are subject to fines for smoking in these vehicles. In private homes, smoking will still be allowed, but smoking areas must be at least 15 meters away from entrances to public facilities such as schools, clinics, and sports facilities.

Smoking will be prohibited in various public and semi-public areas, including bar and restaurant terraces, open-air events and concerts, playgrounds, outdoor hotel pools, sports and cultural facilities, bus stops and train stations, stadiums, university campuses, and schoolyards. Some regions in Spain already have more stringent smoking restrictions, such as on beaches, which will be harmonized nationwide with the implementation of the breaking news.

Minors are prohibited from both buying and consuming electronic products, with parents held directly responsible if minors violate this prohibition. The new balance includes regulations for classic tobacco products, e-cigarettes, vapes, shishas, and tobacco heaters.

The news is expected to have a significant impact on public health in Spain, reducing exposure to second-hand smoke and promoting a healthier lifestyle. While the new balance is awaiting parliamentary approval, it is expected to come into effect by 2026 at the latest.
