In the United States, a contentious debate has emerged surrounding gender-affirming care (GAC) for minors, with 23 states imposing laws that ban or severely limit its provision. The focus of this article is to shed light on the root cause of fear and hate towards the trans community, and to challenge the justifications behind these laws.

The primary concern for trans individuals in the US is not surgery that affirms their gender, but rather the alarming rise in hate crimes and fear. Despite evidence showing that GAC is rarely regretted and can be life-saving, these laws force many transgender minors to either seek care out-of-state or forego treatment entirely, increasing risks such as suicidality among trans youth.

Concerns about medical risks and irreversible effects, such as those cited by Tennessee's legislature, reflect precaution over unknown or long-term effects, despite medical consensus on the relative safety and appropriateness of GAC when properly administered. The argument that minors lack the maturity to understand potential consequences is used to justify restrictions, yet major medical and psychological organizations deem GAC essential and lifesaving for transgender minors.

Recent substantial changes in treatment guidelines and restrictions placed by health authorities in countries like Sweden, Finland, and the UK are also referenced by some states. However, these changes do not necessarily reflect the consensus in the US, where professional organizations continue to support GAC for minors.

Gender-affirming care has become a politically charged issue, with extremist politicians framing transgender health care access as controversial or harmful, leading to legislative attacks on transgender youths' rights to health care. The Supreme Court's recent ruling upholding Tennessee's ban on GAC for minors reinforces the legality of these laws, but it does not address the potential harm they cause to vulnerable trans youth.

A longitudinal study of over 6,000 transgender individuals in the US indicates that the highest risk of suicide is among those under 18 years of age. GAC can provide life-saving confidence and relief to transgender people, regardless of age. The National Library of Medicine reports that prior to initiating GAC, 73.3% of the sample reported a history of suicidal ideation, which drops to 43.4% following the initiation of GAC.

In light of these statistics, it is argued that personal discretion should be considered in the provision of GAC, and that laws limiting GAC generalize a personal issue and should be considered at an individual level. The Federal Government should focus on addressing hate crimes against the trans community rather than passing harmful legislation.

As awareness about GAC increases, there is a rise in blocks on legislation limiting its access. It is crucial that we continue to challenge the justifications behind these laws and advocate for the rights of transgender individuals to receive necessary and life-saving care.
